Collection and recording of personal data / nature and purpose of use

a) Access of website
When accessing our website www.schoenmeier.de, information is automatically sent by the browser used on your terminal device to the server of our website. This information is temporarily stored in a so-called “log file”. The following information is collected without any action of your part and stored until it is automatically deleted:

  • IP address of the requesting computer,
  • date and time of access,
  • name and URL of the file accessed,
  • website from which the website is accessed (Referrer URL),
  •  used browser and operating system of your computer (where applicable) as well as the name of your access provider. The above-mentioned data is processed by us for the following purposes:
    • to ensure a trouble-free establishment of connection by the website,

    •  to ensure a comfortable use of our website,

    •  to evaluate the system security and stability as well as

    •  for other administrative purposes.

The legal basis for the processing of data is Article 6 (1) s. 1 lit. f of the European General Data Protection Regulation (“GDPR”). Our legitimate interests result from the above-mentioned purposes of data collection. In no event will we use the collected data for the purpose of drawing conclusions as to you as an individual. Inclusion of external content („Content“)

a) Google Maps
In order to be able provide you with an interactive map, we use the map service “Google Maps“ of Google. When showing the map, data (including your IP address and location) is transferred to servers of Google in the United States of America and is stored there. This processing is based on our predominant legitimate interests in the best possible commercialization of our offer according to Article 6 (1) s. 1 lit. f GDPR.

Sharing of data

Your personal data will not be transferred to third parties for purposes other than the following ones. We will only share your personal data with third parties, if:

  • you have given your explicit consent thereto in accordance with Article 6 (1) s. 1 lit. a GDPR,
  •  the sharing in accordance with Article 6 (1) s.1 lit. f GDPR is required in order to assert, exercise of defend legal claims and if there is no reason to assume that you have an overriding legitimate interest in your data not being shared,
  •  a legal duty applies with regard to the sharing in accordance with Article 6 (1) s.1 lit. c GDPR, as well as
  •  this is legally permissible in accordance with Article 6 (1) s.1 lit. b GDPR in order to conduct contractual transactions with you.


Cookies

On our website, we use cookies. “Cookies” are small files automatically created by your browser and stored on your terminal device (laptop, tablet pc, smartphone, etc.) when you visit our website. Cookies do not harm your terminal device and do not contain any viruses, Trojans or other malware.

Rights of the data subject

You are entitled to do the following:

  • In accordance with Art. 15 GDPR, you may request information about your personal data processed by us. In particular, you may request information about the purpose of the processing, the category of personal data, the categories of recipients to which your data is or was disclosed, the envisaged duration of data storage, the existence of a right to rectify, erase, restrict the processing or oppose, the existence of a right to lodge a complaint, the source of your data to the extent that it was not collected by us, as well as the existence of an automated decision-making, including profiling, and of meaningful information about the details (if applicable).

  • In accordance with Art. 16 GDPR, you may obtain from us without undue delay the rectification of your inaccurate personal data stored by us as well as the completion of your incomplete personal data stored by us.

  • In accordance with Art. 17 GDPR, you may obtain from us the erasure of your personal data stored by us, unless the processing is necessary for exercising the right of freedom of expression and information, for complying with a legal obligation, for reasons of public interest or for establishing, exercising or defending legal claims.

  • In accordance with Art. 18 GDPR, you may obtain from us the restriction of processing your personal data where the accuracy of the personal data is contested by you, the processing is unlawful and you oppose the erasure of the personal data, we no longer need the personal data for the purposes of the processing, but they are required by you for the establishment, exercise or defence of legal claims, or you have objected to processing pursuant to Art. 21 GDPR.

  • In accordance with Art. 20 GDPR, you may receive the personal data provided to us in a structured, commonly used and machine-readable format and request transmission of those data to another controller.

  • In accordance with Art. 7 (3) GDPR, you may withdraw your consent once given vis-à-vis us at any time. The withdrawal of consent results in us not being allowed to proceed in the future with the processing of data for which such consent was given.

  • In accordance with Art. 77 GDPR, you may lodge a complaint with a supervisory authority. As a general rule, you can address the supervisory authority of your usual place of residence, place of work or location of our solicitors’ office.

 

Right of objection

If your personal data is processed based on legitimate interests in accordance with Art. 6 (1) s. 1 lit. f GDPR, you have the right to object in accordance with Art. 21 GDPR to the processing of your personal data, where reasons exist that result from your special situation or if such objection is directed against direct marketing purposes. In the last case, you have a general right of objection, without you having to provide evidence of a special situation to us.
